1. The Service
PICO provides AI-assisted tools that can create video results from user prompts, selected images or videos, style options, and other creative instructions. Features, availability, limits, supported formats, and generation behavior may change as the Service evolves.
You must be legally capable of agreeing to these Terms. If you use the Service for an organization or another person, you represent that you have authority to bind them, and "you" includes that organization or person.
2. Your Inputs
"Inputs" include prompts, text, images, videos, style selections, instructions, and any other material you submit to the Service. As between you and PICO, you retain any rights you have in your Inputs.
You grant us a non-exclusive, worldwide, limited license to host, copy, transmit, modify, format, process, and otherwise use your Inputs as reasonably necessary to operate, secure, troubleshoot, and provide the Service, including generating and delivering results you request. This license also permits processing by service providers that support those functions on our behalf. It does not give us ownership of your Inputs.
You represent and warrant that you have all rights, permissions, licenses, and lawful bases needed to submit and use your Inputs through the Service and to grant the license above.
3. Images, Likenesses, and Consent
If an Input depicts or identifies another person, you are responsible for obtaining any permission required to upload, process, alter, animate, publish, or otherwise use that person's image, voice, likeness, personal information, or performance. This includes consent required for sensitive, commercial, or synthetic-media uses.
You must not create or distribute content involving a person in a misleading, exploitative, harassing, sexual, or otherwise unlawful manner, or in a way that violates their privacy, publicity, intellectual-property, or other rights.
4. Generated Outputs
"Outputs" are videos, previews, or other results generated by the Service in response to your Inputs. Subject to these Terms and applicable law, and as between you and PICO, you may use Outputs generated for you. You grant us a non-exclusive, worldwide, limited license to host, store, transmit, format, and process Outputs as reasonably necessary to provide, maintain, secure, and support the Service.
AI-generated material can be unpredictable. Outputs may be inaccurate, incomplete, offensive, unsuitable, or similar to content generated for others. The Service does not guarantee that an Output is unique, protectable, non-infringing, or appropriate for a particular purpose.
You are responsible for reviewing each Output before relying on, publishing, sharing, or using it. You must make any disclosure that applicable law, platform policy, professional obligation, or the context of use requires concerning AI-generated or materially altered content. Do not present an Output as authentic footage, a true event, or a real person's statement when doing so would mislead others.
5. Prohibited Conduct and Content
You may not use the Service to create, upload, request, promote, or distribute content, or engage in conduct, that:
- violates applicable law, regulation, court order, or another person's rights;
- infringes or misappropriates copyright, trademark, privacy, publicity, confidentiality, or other intellectual-property or proprietary rights;
- facilitates fraud, deception, scams, identity theft, fabricated evidence, or materially misleading representations;
- impersonates another person or falsely suggests their authorization, endorsement, actions, or statements;
- uses a person's image, likeness, voice, or personal information without permission where permission is required;
- creates or sexualizes intimate, exploitative, or humiliating material involving a real or identifiable person without their voluntary, informed consent;
- involves child sexual abuse material, sexual exploitation of minors, or any sexualized depiction of a minor;
- threatens, harasses, stalks, defames, exploits, or incites violence or unlawful discrimination;
- introduces malware, attempts unauthorized access, interferes with operation, bypasses safeguards or usage limits, probes vulnerabilities, or places unreasonable load on the Service;
- uses automated means to extract data or Outputs except as expressly permitted by us; or
- helps another person do any of the above.
We may review reported or suspected misuse and take appropriate action, including refusing a generation request, restricting access, preserving relevant information where lawful, or contacting appropriate authorities when necessary to protect rights or safety.
6. Your Responsibilities
You are responsible for your use of the Service, your Inputs and Outputs, compliance with applicable law, and the consequences of publishing or sharing generated content. You must protect your device and any credentials associated with the Service or Google Play. Notify us if you believe unauthorized use has occurred.
Professional, legal, medical, financial, safety-critical, and other consequential decisions should not be based solely on AI-generated content. Obtain qualified review where appropriate.
7. Paid Features and Google Play
The Service may offer paid features, subscriptions, credits, or other purchases. If a purchase is offered through Google Play, payment, billing, cancellation, renewal, and refund handling are also subject to the applicable Google Play terms and account settings. Prices, taxes, included benefits, and renewal information will be presented at the point of purchase.
You authorize the applicable store to charge the payment method associated with your store account for purchases you confirm. Except where required by law or applicable store rules, charges are subject to the purchase terms shown to you. Deleting the app does not necessarily cancel a subscription; if a subscription is offered, manage it through the relevant Google Play controls.
We may change paid offerings prospectively. Any material change to an active recurring purchase will be handled in accordance with applicable law and store requirements.
8. Intellectual Property
The Service, including its software, design, interfaces, branding, and materials provided by us, is owned by us or our licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you in the Service itself.
If you provide feedback or suggestions, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation, provided we do not identify you publicly as its source without permission.
9. Third-Party Services
The Service may interact with third-party services, such as Google Play, operating-system features, or sharing destinations you choose. We do not control those services, and your use of them is governed by their own terms and policies. We are not responsible for third-party services to the extent permitted by law.
10. Availability, Changes, and Termination
We may modify, suspend, limit, or discontinue all or part of the Service when reasonably necessary, including for maintenance, security, legal compliance, or product changes. We do not promise that every feature or Output will always be available.
You may stop using the Service at any time. We may restrict or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay an applicable charge, or used the Service in a way that could harm others or the Service. Provisions that by their nature should survive termination will survive, including provisions concerning licenses needed for retained records, ownership, disclaimers, liability, and disputes.
11. Disclaimers
To the maximum extent permitted by law, the Service and Outputs are provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or that Outputs will satisfy your expectations.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by law, PICO and its affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, opportunities, or business, arising from or related to the Service, Inputs, Outputs, or these Terms.
Where liability cannot be excluded, it will be limited to the extent permitted by applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PICO and its affiliates and personnel from claims, losses, liabilities, and reasonable expenses arising from your Inputs, your use or distribution of Outputs, your use of the Service, your violation of these Terms, or your violation of another person's rights.
14. Changes to These Terms
We may update these Terms to reflect changes to the Service, legal requirements, or our practices. We will revise the "Last Updated" date when we do and may provide additional notice for material changes where appropriate. If you do not agree to revised Terms, you must stop using the Service.
15. General Terms
These Terms and the Privacy Policy form the agreement between you and us concerning the Service. If a provision is found unenforceable, it will be modified only to the extent needed or severed, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours as part of a business reorganization or as otherwise permitted by law.
